1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Paul Gerst Consulting (“we,” “us,” or “our”), concerning your access to and use of the paulgerst.com website and our consulting services. By accessing the Site or purchasing services, you agree that you have read, understood, and agreed to be bound by all of these Terms.
2. Independent Contractor Status
Paul Gerst is an independent consultant and is not an employee, agent, or representative of Google LLC. We do not have special access to Google’s internal systems, and we cannot guarantee specific outcomes that are solely at Google’s discretion.
3. Services & Limitations
A. The “Rescue Mission” (Suspensions)
While we use industry best practices and our 17+ years of experience to appeal suspensions, we cannot guarantee reinstatement. Google’s internal policies are opaque and final decisions rest solely with Google.
- Client Responsibility: You agree to provide accurate, truthful business documentation (business licenses, utility bills, etc.). Submitting falsified documents is grounds for immediate termination of our services without refund.
B. Rankings & SEO
We do not guarantee a specific ranking on Google Maps (e.g., “#1 spot”). Search algorithms change daily. We promise to apply best practices to maximize your visibility, but we do not promise specific traffic numbers or revenue.
4. Client Responsibilities
You represent that:
- You are the authorized owner or representative of the business profile we are managing.
- All information you provide to us is accurate and current.
- You will comply with Google’s Guidelines for representing your business on Google.
5. Payments & Refunds
- Consulting Fees: Fees for audits and rescue missions are due upon invoice receipt unless otherwise agreed.
- Refund Policy: Due to the nature of consulting work and the time invested, all fees are non-refundable, regardless of Google’s final decision on a suspension or ranking. You are paying for our time, expertise, and process, not a guaranteed algorithmic result.
6. Limitation of Liability
To the fullest extent permitted by law, Paul Gerst Consulting will not be liable to you for any lost profit, lost revenue, lost data, or any indirect, consequential, exemplary, incidental, or special damages arising from your use of the site or our services, even if we have been advised of the possibility of such damages.
7. Governing Law
These Terms shall be governed by and defined following the laws of The State of Texas. You irrevocably consent that the courts of Texas shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
